Terms & Conditions

These Terms constitute a legally binding agreement governing your use of Fatory SaaS platform, including inventory management, warehouse operations, and related services.

1. Acceptance of Terms

By accessing or using Fatory, you agree to be bound by these Terms, applicable laws, and any referenced policies including Privacy Policy and Data Processing Agreement (DPA). If you do not agree, you must immediately discontinue use of the Service.

2. Service Definition & Scope

Fatory is a multi-tenant SaaS platform providing inventory management, warehouse operations, stock opname automation, barcode tracking, analytics, and API integrations. The Service may evolve, be modified, or discontinued in part or full at our discretion.

3. Account Registration & Security

Users must provide accurate information and are solely responsible for safeguarding credentials. Any activity under your account is deemed authorized. You must immediately notify us of unauthorized access or suspected breach.

4. Data Ownership, Control & License

You retain full ownership of all inventory, warehouse, and business data. By using the Service, you grant us a limited, non-exclusive license to process data solely for service delivery, analytics, security, and system optimization purposes.

5. GDPR Compliance (EU Users)

For users within the European Economic Area (EEA), we act as a Data Processor under GDPR. We process personal data based on lawful grounds such as contractual necessity and legitimate interest. Users may exercise rights including access, rectification, deletion, restriction, and portability of data.

6. CCPA Compliance (California Users)

Under the California Consumer Privacy Act (CCPA), users have rights to know, delete, and opt-out of data sharing where applicable. Fatory does not sell personal data. Any data processing is strictly for service functionality and operational requirements.

7. Acceptable Use Policy

Users agree not to misuse the platform, including but not limited to unauthorized access, reverse engineering, scraping, injecting malicious code, disrupting services, or using the platform for unlawful or harmful activities.

8. API Usage & Rate Limits

API access is subject to rate limits, authentication requirements, and usage policies. Abuse, excessive requests, or attempts to bypass limitations may result in immediate suspension or termination.

9. Data Processing, Subprocessors & Transfers

We may engage subprocessors (cloud providers, analytics, infrastructure services) to deliver the Service. Data may be transferred internationally with appropriate safeguards such as Standard Contractual Clauses (SCCs).

10. Data Security & Incident Response

We implement industry-standard security measures including encryption at rest and in transit, access controls, audit logs, intrusion detection, and continuous monitoring. Security incidents will be handled according to our incident response policy.

Legal Agreement in Effect

By using Fatory, you acknowledge and agree to these Terms, including data protection and compliance obligations under GDPR and CCPA.
